Summary

We assume no liability under any circumstances whatsoever, including negligence, breach of statutory duty, torts, contract or otherwise, regarding the full scope of commercial losses arising from this agreement. We cover indirect, consequential loss of any nature, damage to costs and expenses, plus other damages such as profit losses, anticipated business interruptions, data loss, reputation damage, third party claims, non-performance if caused by our own negligence or willful breach, direct or indirect losses due to your breaches in relation to your obligations, disputes over the choice of goods, and failure to perform specific obligations due to extraordinary delays. We can terminate trading relationships or suspend deliveries instantly upon payment defaults, violence, harassment, bullying threats, or unsatisfactory conduct by staff within our supply chain. Furthermore, we hold you liable up to 30 days prior notice if your assets fall below liabilities, or if you become unable to repay debts or enter into arrangements with creditors. We also assume no responsibility for losses resulting from the inability to pay debts themselves, or if you suspend operations and threaten to do so, as our financial position becomes insufficient to cover us legally. Finally, we bear no liability for losses arising from your failure to perform specific terms regarding the supply of goods or their suitability for your own business purposes in relation to a particular customer contract.
